These Terms and Conditions (“Agreement”) govern all services provided by Continental Moving Company LLC (“Carrier”), a Massachusetts-registered entity. By booking services with Carrier, the Customer (“Shipper,” “Consignee,” or “Owner”) agrees to be bound by these Terms.
Understand Your Quote
Please note, this quote is just an estimate and provided for your convenience only. We give you a database average for generally similar moves. It is best to consider this a thinking tool. However: your final cost is based on hourly rate and actual time your move will take. Additional time may be required if your move involves long walks from your apartment to the truck, narrow hallways and/or tight staircases, disassembling and reassembling of furniture, hoisting, moving of oversized, antiques items, ones with glass and/or marble, appliances move and items over 300lb. It is important to understand, that the move time will also depend on how well you are packed and organized: all drawers of all the furniture must be emptied, and all miscellaneous items packed neatly into moving boxes of correct sizes.
Rates displayed are subject to change without notice. Final pricing may vary based on factors including, but not limited to, capacity availability, surge in demand, seasonal or holiday periods, building access, parking requirements, inventory adjustments, or other job-specific conditions. Continental Moving Company reserves the right to adjust rates at its sole discretion. Displayed rates are for informational purposes only and do not constitute a binding offer until confirmed in writing by our office.
Customer acknowledges that quoted hours are not guaranteed and that delays due to weather, traffic, building restrictions, or customer preparation (packing/organization) are outside Carrier’s control.
PAYMENTS
All payments MUST be made the same day as the move is completed. If moves are done over multiple days, payment will be made at the end of EACH day for the charges incurred by the customer that day. All charges to be paid in cash, via “Venmo“ app, via “Cash” app, via “Paypal” app, money order, cashier's check, or certified check, Debit card. Continental Moving Company LLC does accept credit cards for a 3% fee. Any damage claims will be processed only AFTER payment is given in full as dictated by Federal Law.
Customer agrees not to dispute or reverse charges with their bank/credit card issuer after services are rendered. Unpaid balances will enforce Carrier to retain a lien on all property transported until payment is made in full. In addition, an accrued interest at 1.5% per month, plus reasonable attorney’s fees, collection costs, and storage charges will also be added to the final bill.
DEPOSIT AND CANCELLATION POLICY
A deposit is required to secure the booking. Continental Moving Company requires a deposit of $50.00 for a move with 2 movers. Deposits may be refunded if the move is canceled more than 7 days before the scheduled start. For cancellations within the 7-day period, the deposit is non-refundable. The customer has the right to change the booking date once within the 7 days window before the scheduled date for an additional $50 fee. After that the deposit + the additional fee become non-refundable. All refunds are at the sole discretion of Continental Moving Company. Continental Moving Company will determine the number of movers required for each job. By accepting this quote, the client agrees with our deposit and cancellation policy.
Carrier shall not be liable for costs if a move must be rescheduled or canceled due to severe weather, equipment breakdown, government restrictions, or building/parking issues beyond Carrier’s control.
MINIMUM CHARGES
All jobs have a two hour minimum labor charge and one flat travel fee for the truck. Continental Moving Company LLC reserves the right to charge additional hourly minimum charges at their discretion if the work requires it. The labor time starts when our truck arrives at the pick up location and stops when the truck will be fully unloaded at the destination.
Additional surcharges may apply for jobs requiring excessive stairs, long carries (75+ feet), elevator delays, waiting time, or service beyond 20 miles from Boston city limits.
BILLING
We bill on 15 min increments. For example, if we arrive at 10:47 and the job is completed at 2:33 we will charge you from 10:45 until 2.30, or 3.45 hours.
Time begins when truck arrives at origin and ends when truck is fully unloaded and equipment returned to vehicle.
Additional surcharges may apply for: long carries (75+ ft.), excessive stairs, elevator delays, waiting time, or service outside normal radius, building restrictions, or customer preparation (packing/organization).
PARKING PERMITS
Specifically for Cambridge, Boston, and the towns immediately surrounding Boston, Continental Moving Company LLC can secure parking permits for a moving truck at your current and next residence to ensure that the move goes as smooth as possible at a cost of $140 for each permit location. A standard moving permit reserves two parking spaces for one day from 7 a.m. - 5 p.m. You can only apply online if your moving date is at least two weeks away, and no more than four weeks away. The street space you want to reserve needs to be an actual parking spot. The spot can be residential, commercial, metered, or something else, but it must be legal to park a vehicle there. If you want a permit in the North End from July 1 - August 31, you must have permission from the City before applying online. Carrier is not responsible for tickets, towing, or fines if permits are not secured or if client fails to provide legal parking access.
STORAGE FEES
If the shipper requests the shipment be held in storage before delivery to the point of destination, shipper will be made aware that Continental Moving Company LLC does NOT provide warehouse storage as a service. At Continental Moving Company LLC's discretion, we can store items overnight in a locked truck or a garage at a cost of $175 per night for 0-17 foot trucks (as listed by the manufacturers “advertised” size) and $200 for 18 foot or larger trucks (as listed by the manufacturers “advertised” size). Customers acknowledge that moving trucks are water resistant and NOT waterproof. Continental Moving Company LLC is NOT liable for any shipment put in a moving truck in which water damage occurs. This INCLUDES any shipment stored overnight.
Items stored in moving trucks are at owner’s risk. Carrier is not liable for theft, vandalism, fire, or water damage while items are in truck storage.
SEC. 1
1. The Carrier or party in possession of any of the property herein described ("Property") shall be liable as a common law for any loss thereof or damage thereto, except as herein provided.
a. No Carrier or party in possession of all or any of the Property ("Carrier") shall be liable for any loss, damage or delay caused by act of God, public enemy, war, declared or undeclared, acts of public authority, quarantine, riots, strikes, perils of navigation, act of de- fault of Shipper or owner, nature of Property or defect or inherent vice, occurrences in customs warehouse, or for any loss or damage to paintings, statuary, ornamental items, works of art, articles of unusual nature or value, photographs or pictures, antiques, dishes, glassware, musical instruments, vases, mirrors, marble or enamel pieces, lamps, lamp shades or other fragile articles, unless such loss or damage was caused by negligence of the Carrier, and the responsibility to prove such negligence shall be on the shipper, except where arrangements have been made for the packing and unpacking of such articles by the Carrier or its agent. No carrier shall be held liable for the internal malfunction of any computerized, electrical or mechanical item or piece of equipment, whether or not such articles are packed, unpacked, or packed and unpacked by the Shipper or his agent or Carrier or its agents. No Carrier shall be liable for damage to or loss of contents of pieces of furniture, crates, bundles, cartons, boxes, barrels or other containers unless such contents are open for Carrier's inspection and then only for such articles as are specifically listed by the Shipper and receipted for by the Carrier or its agent.
b. No Carrier shall be liable for delay caused by obstructions, faulty or impassable highways, lack of capacity of any highway, bridge, ferry, or caused by breakdown, or mechanical defect of vehicles or equipment.
c. Carrier's liability shall be that of a warehouseman, only, for loss, damage or delay caused by fire occurring after the arrival of the Property at destination or at the port of export and tender of delivery of the Property to the party entitled to receive it has been made. Except in case of negligence of the Carrier, Carrier shall not be liable for loss, damage, or delay occurring while the Property is stopped and held or stored in transit on the request of the Shipper, owner, or party entitled to make such request, whether such request was made before or after Carrier came into possession of the Property.
Unless otherwise agreed in writing, Carrier’s liability is limited to $0.60 per pound per article, in accordance with Federal Released Valuation standards. Customer may request higher coverage in writing at additional cost. Carrier is not liable for perishable items, hazardous goods, plants, pets, jewelry, firearms, or currency.
SEC. 2
1. Carrier shall have the right in case of physical necessity to forward the Property by any Carrier or route between the point of shipment and the point of destination. In all cases not prohibited by law, where a lower value than actual value has been represented in writing by the Shipper or as been agreed upon in writing as the released value of the Property as determined by the classification or tariffs upon which the rate is based, such lower value less charges shall be the maximum amount to be recovered, whether or not such loss or damage occurs from negligence.
2. As a condition precedent to recovery, claims must be filed in writing with the receiving or delivering Carrier, or Carrier is- suing this proposal for service and bill of lading, or Carrier in possession of the Property when the loss, damage, injury, or delay occurred, within 10 days after delivery of the Property; and suits shall be instituted against any Carrier only within two years and on day from the day when notice in writing is given by the Carrier to the claimant that the Carrier has disallowed by claim of any part or parts thereof specified in the notice. Where claims are not filed or suits are not instituted in accordance with the foregoing provisions, no Carrier hereunder shall be liable.
3. Any Carrier or party liable on account of loss or damage to any of the Property shall have the full benefit of any insurance that may have been affected upon or on account of the Property so long as this shall not avoid the policies or contracts of insurance; provided that the Carrier reimbursed the claimant for the premium paid thereon.
SEC. 3
Except where such service is required as the result of Carrier's negligence, all Property shall be subject to necessary cooperage, packing and repacking at owner's cost.
SEC. 4
1. Carrier shall have the right to retain possession of any Property transported by it and to take and place the same in storage at the charge and expense of the Shipper, until all tariff rates and charges thereon have been paid in cash, money order, debit card, credit card or certified check. Nothing herein shall limit the right of Carrier to require, at a time of or before shipment, the prepayment in part or in full or guarantee of the charges.
2. Property not received by the party entitled to receive it after appropriate notice, may be kept in vehicle, warehouse or place of business of the Carrier, subject to all lawful charges and to Carrier's responsibility as warehouseman only, or at the option of the Carrier, may be removed to and stored in a warehouse at the point of delivery or at other available points at the cost of the owner, and there held without liability on the part of the Carrier, and subject to a lien for all transportation and other lawful charges, including a reasonable charge for storage. In the event the Consignee cannot be found at the address given on the bill of lading for notification, the Carrier shall be discharged from liability upon sending a notice to Shipper showing the warehouse in which such Property has been placed, subject to the provisions of this paragraph.
Carrier retains lien rights until all balances, interest, storage fees, attorney’s fees, and collection costs are satisfied.
SEC. 5
1. Where Carrier is directed to take Property from a place or places at which the Consignor or his agent is not present, the Property shall be at the risk of the owner before loading.
2. Where Carrier is directed to unload or deliver Property at a place or places at which the Consignee or its agent is not present, the Property shall be at the risk of the owner after unloading or delivery.
If customer is not present, the signature of their agent, or absence at delivery, constitutes acceptance of delivery and transfer of risk.
SEC. 6
No Carrier will carry or be liable in any way for any documents, specie, or for any article of extraordinary value unless a special agreement to do so and a stipulated value of the articles are endorsed hereon.
Carrier will not transport pets, plants, firearms, ammunition, jewelry, currency, or other prohibited items.
SEC. 7
Explosives or dangerous goods will not be accepted for shipment. Every party whether principal or agent shipping such goods shall be liable for any indemnify Carrier against all loss or damage caused by such goods and Carrier will not be liable for safe delivery of the shipment.
SEC. 8
The owner or Consignee shall pay the advances, tariff charges, packing and storage, if any, and all other lawful charges accruing on said Property. No carrier shall deliver or relinquish possession at destination of the Property until all tariff and charges thereon have been paid. Consignor shall also be liable for the advances, tariff charges, packing, storage, and all other lawful charges, except as otherwise agreed in writing. The beneficial owner shall also be liable for all charges due to Carrier where not paid by Consignor or Consignee. If the Consignor or Consignee has given to the Carrier erroneous information as to the identity of the beneficial owner, such Consignor or Consignee shall be liable for such additional charges and any attorney's fees incurred by Carrier as a result of this disclosure. Nothing herein shall limit the right of the Carrier to require, at the time of shipment, the prepayment of the charges, If upon inspection it is ascertained that the articles shipped are not those described herein, the advances or tariff charges must be paid upon the articles actually shipped.
SEC. 9
If this proposal for service and bill of lading is issued on the order of the Shipper or his agent, in exchange or in substitution for another proposal for service and bill of lading, the Shipper's signature to the prior proposal for service and bill of lading as to the statement of the value or otherwise or election for common law or bill of lading liability, in or in connection with such prior proposal for service and bill of lading, shall be considered a part of this proposal for service and bill of lading as fully as if the same were written or made in or in connection with this proposal for service and bill of lading.
No claims will be processed until all charges are paid in full.
SEC. 10
Any alteration in this proposal for service and bill of lading made without the special notation hereon of the Carrier shall be without effect, and this document shall be enforceable according to its original tenor.
SEC.11
Continental Moving Company LLC reserves the right not to move items that are not properly prepared for shipment.
SEC.12
We do assembly work. Continental Moving Company LLC will charge our normal hourly rate for all disassembly or assembly of items. Our policy is to reassemble anything that we disassembled, as we can ensure all necessary parts are taken care of and accounted for. We will NOT assemble any items we did not disassemble. All assembly of NEW boxed furniture (Ikea, Wayfair, etc.) needs to be discussed ahead of time as this can add a significant amount of time to any job so our schedule needs to be able to accommodate this if possible and it is not guaranteed.
SEC.13
Continental Moving Company LLC will move particle board furniture but will not take liability for any damage. Furniture from low cost manufacturers such as Ikea is not meant to be moved. We have tons of experience doing so safely but cannot guarantee safe transport due to low quality build materials and/or improper assembly.
Carrier is not responsible for damage to ready-to-assemble (RTA) or particle board furniture caused by inherent design weakness or prior improper assembly.
